If your visa status has been deterring you from buying property in the US, learn more about obtaining US residency status through investment and the EB-5 Visa* The US is known as the land of opportunities and entrepreneurial spirit, and has long attracted global business investors from around the world. Often interests intertwine in commercial investment, residential and recreational properties. International investors face the additional complexities in purchasing and using a US residence. Immigration, tax, currency and financing issues all play a bigger role for global investors. The EB-5 visa has emerged as one important tool for those willing to invest in the US as a means of obtaining US residency status. Known informally as the investment or entrepreneurial visa, the EB-5 encourages foreign nationals to invest specified amounts of money, typically $500,000 USD or $1,000,000 USD, in commercial enterprises or development projects that create jobs for US workers. In return, they receive conditional permanent residency. While other types of visas may have waiting periods or long delays in processing, the EB-5 has no waiting period after approval. The government is authorized to grant 10,000 EB-5s per year. There are many scenarios under which the EB-5 might be the right answer to an international investor’s visa related residency issues, and although the EB-5 may fit your needs, it is not a simple program. The EB-5 visa was designed to attract foreign capital to the US specifically for job creation. It benefits the housing market and communities, particularly disadvantaged ones, through investment in the local economy. Upon approval, an applicant receives green cards for the individual, spouse and unmarried children under the age of 21, with the ability to live anywhere within the US, move freely about the country, and in and out of it.
TWO PATHS There are two ways to apply for the EB-5 visa: 1. Under the original program as an individual investor/entrepreneur; or 2. Under the Regional Center Pilot Program contributing to an investment pool.
Once the EB-5 visa is granted, the individual and family became conditional permanent residents. After two years the visa holder must petition for removal of conditional status by submitting proof that the original requirements for the visa were met.

DEFINITIONS:
TEA: Targeted Employment Area A rural area or an area experiencing high unemployment of at least 150% of the national average.
Regional Center A public or private economic unit engaged in the promotion of economic growth, improved regional productivity, job creation and increased domestic capital investment.
Troubled Business A business in existence for at least two years that has incurred a net loss of at least 20% of its net worth in the previous 12 to 24 months.
QUALIFIED ADVISORS
The US Citizenship and Immigration Services (USCIS) requires extensive documentation to be submitted with the visa application on the commitment of required funding, lawful source of funds, and viability of the business plan and job projections.
An Immigration Attorney with experience in the EB-5 Visa and immigration law can help an investor navigate the complex process. The EB-5 immigration attorney can provide a list of well-established Regional Centers into which to inquire about investments, and provide guidance on legal matters, including immigration risk. The Investor’s Financial Advisors who are familiar with the investor’s situation should conduct due diligence on the project to address the financial risk and potential benefit. A Certified Public Accountant who has experience with international tax issues and currency transactions requiring the filing of specific forms with the Internal Revenue Service (IRS) should be consulted. After consultation with your qualified legal and other financial advisors concerning investment and the EB-5 Visa process, a US based international Realtor® can assist you with real estate property identification and purchases. If your visa status has been deterring you from buying property in the US the EB-5 Visa may allow you to begin the process of buying a home and investment real estate within the US. In the US, the Realtor® acting as the Buyer’s Agent, requires a written agreement with the Buyer authorizing the Agent to provide client services.
